Cutie Maps Terms of Use

These Terms are an agreement between you and Music AI Studio Ltd ("we", "us", "our") about your use of the Cutie Maps app for iPhone and CarPlay (the "App"). By using the App you accept them.

1. Your licence to use the App

We give you a personal, non-exclusive, non-transferable licence to use the App on Apple devices you own or control, under these Terms and the App Store's usage rules. You may not copy, modify, reverse engineer or resell the App, except where the law allows it.

2. Drive safely

Directions are an aid, not a replacement for your own judgement. Always watch the road, follow traffic laws, road signs and the directions of the police, and drive for the conditions. Routes, speed limits, road closures, travel times and place details can be wrong, out of date or unsuitable for your vehicle, and a route may lead somewhere that is closed, unsafe or not allowed. Set your destination and settings before you drive, and don't handle your phone while driving; use CarPlay or ask a passenger. The navigation voices are characters for fun, so take their jokes and asides lightly and their directions with the same care as any other.

3. Maps, places and weather

Maps, search results, routes and traffic come from Mapbox and its data providers, including OpenStreetMap contributors; weather comes from Apple Weather. They are provided under those providers' own terms, which you can read from the ⓘ button on the map and the "Weather data sources" link in Settings. We don't own, check or guarantee this data, and places, businesses and opening hours may have changed.

4. Subscriptions

Some features need Cutie Maps Pro. You can have it weekly or yearly as a subscription, or buy it once for life. The price and length of each plan, any free trial and any introductory price are shown in the App before you buy, and the App Store shows them again when you confirm.

• Payment is charged to your Apple ID when you confirm the purchase, or when a free trial ends.
• A subscription renews automatically for the same length and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in your Apple ID's subscription settings (Settings → your name → Subscriptions). Cancelling stops the next renewal; you keep access until the end of the period you've paid for.
• Some plans open with a free trial or a cheaper first period. Apple allows one such offer per subscription group for each Apple Account, ever: whichever you take is the one you get, and a plan you are no longer eligible for simply starts at its normal price, which the App shows you before you buy.
• If you buy a subscription during a free trial, any unused part of the trial ends when the purchase is made.
• Refunds are handled by Apple under its own policies, at reportaproblem.apple.com.

Lifetime access is a one-time purchase, not a subscription: it doesn't renew, there is nothing to cancel, and it stays with the Apple Account that bought it — use Restore to get it back on another device or after reinstalling.

We may change what's included in a plan or its price; a price increase applies only from your next renewal, after Apple has told you about it where the law requires.

5. What you make

The widgets you design and the photos you add to them are yours and stay on your device. Only add photos you have the right to use.

6. Disclaimer

The App is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement, and we don't promise that the App, its maps, routes or directions will be accurate, uninterrupted or error-free.

7. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.

Subject to that, and to the fullest extent the law allows: we are not liable for any indirect, incidental, special or consequential loss, for loss of profits, revenue, data or goodwill, or for loss or damage that results from following a route, direction or other information in the App without the care described in section 2; and our total liability to you for all claims relating to the App is limited to the greater of the amount you paid for the App and its subscriptions in the 12 months before the claim arose and USD 100.

If you are a consumer in the UK or EU, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill.

8. Apple terms

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability, legal or regulatory compliance, or intellectual property infringement. If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with Apple's Standard End User Licence Agreement and the App Store Terms of Service. You confirm that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.

9. Governing law and disputes

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK or in the EU, you also benefit from the mandatory consumer protection laws of the country where you live, and you may bring proceedings in your local courts.

10. General

We may update these Terms; if a change is material, we'll post it here before it takes effect. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and the Cutie Maps Privacy Policy are the whole agreement between you and us about the App.
